These Terms of Use ("Terms") govern your access to and use of the FoamCalc mobile application (the "App") and this website, foamcalc.com (the "Site"), both operated by Jack-High Software LLC, a Colorado limited liability company ("we," "us," or "our"). By downloading, installing, or using the App, or by accessing the Site, you agree to these Terms.
The App is an estimating tool, not a professional substitute
FoamCalc provides estimates and reference calculations intended for bidding and field use by spray polyurethane foam (SPF) insulation professionals. It is not a substitute for a foam manufacturer's own product data sheets, a licensed professional's judgment, or verification with your local building department. FoamCalc does not certify, verify, or guarantee code compliance of any kind — its R-value reference screen returns thickness/R-value figures only, never a pass/fail or "meets code" determination, and you are solely responsible for confirming current code requirements with the appropriate authority having jurisdiction before bidding, purchasing materials, or performing work.
Subscriptions and in-app purchases
FoamCalc's Pro tier is offered as an auto-renewing monthly subscription, an auto-renewing annual subscription, or a one-time lifetime purchase, at the prices displayed in the App at the time of purchase. All subscriptions and purchases are billed and processed by the Apple App Store or Google Play, not by us directly.
- Billing and auto-renewal. Monthly and annual subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before the renewal date, and your payment method on file with Apple or Google will be charged for renewal.
- Cancellation. Subscriptions can only be canceled through your Apple ID account settings or your Google Play account settings — not through the App and not through this Site, since neither FoamCalc nor Jack-High Software LLC has the ability to process a cancellation on your behalf.
- Refunds. All refund requests are handled exclusively under Apple's or Google's own refund policies, through their respective support channels. Jack-High Software LLC does not process refunds directly.
- Lifetime purchase. The lifetime option is a one-time, non-consumable purchase that unlocks the Pro tier permanently on accounts that complete the purchase, subject to the platform's own purchase and restoration mechanisms.
Acceptable use
You agree to use the App and Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of the App or Site by, any other person.
Intellectual property
The App, the Site, and their content — including text, graphics, calculators, and design elements — are the property of Jack-High Software LLC unless otherwise noted, and are protected by applicable intellectual property laws. You may not reproduce, distribute, reverse-engineer, or create derivative works from the App or Site without our prior written consent.
Disclaimer of warranties
The App and Site are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that calculations will be error-free, that the App will be uninterrupted, or that reference data (loss factors, yields, R-values, production rates, and similar figures) reflects your specific job conditions — these are editable defaults compiled from general industry knowledge, not guaranteed facts, and you are responsible for adjusting them to match your own materials, equipment, and conditions.
Limitation of liability
To the fullest extent permitted by law, Jack-High Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or the cost of a misestimated job, arising out of or in connection with your use of, or inability to use, the App or Site, even if we have been advised of the possibility of such damages.
Changes to these Terms
We may revise these Terms at any time. Continued use of the App or Site after changes are posted constitutes your acceptance of the revised Terms.
Governing law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles.
