These Terms of Use ("Terms") govern your access to and use of the FoamCalc mobile application (the "App") and this website, foamcalc.com (the "Site"), both operated by Jack-High Software LLC, a Colorado limited liability company ("we," "us," or "our"). By downloading, installing, or using the App, or by accessing the Site, you agree to these Terms.

The App is an estimating tool, not a professional substitute

FoamCalc provides estimates and reference calculations intended for bidding and field use by spray polyurethane foam (SPF) insulation professionals. It is not a substitute for a foam manufacturer's own product data sheets, a licensed professional's judgment, or verification with your local building department. FoamCalc does not certify, verify, or guarantee code compliance of any kind. Its R-value reference screen returns thickness/R-value figures only, never a pass/fail or "meets code" determination, and you are solely responsible for confirming current code requirements with the appropriate authority having jurisdiction before bidding, purchasing materials, or performing work.

Documents the App produces

The App produces documents from what you enter, including customer proposals, order sheets and crew sheets. They are templates. You are responsible for everything in a document you send, including its measurements, R-values, prices, exclusions and terms.

A proposal a customer signs is an agreement between you and your customer, and we are not a party to it. Many states and provinces set rules for contracts with homeowners, such as license numbers, cancellation notices and required disclosures. You are responsible for adding whatever the law where you work requires, and for having your documents reviewed by your own attorney where that is called for.

R-values and manufacturer data

The R-per-inch figures the App starts with are general rules of thumb. Before you give a customer an R-value, replace them with the tested figures from your product's manufacturer data sheet. In the United States the Federal Trade Commission's R-value Rule (16 CFR Part 460) sets what installers must tell customers about R-value, and meeting it is your responsibility.

Pass thickness, cool-down time between passes and every other application limit are set by the foam's manufacturer. The App's pass planner starts from general defaults. Follow your product's data sheet and the manufacturer's instructions on every job.

Subscriptions and in-app purchases

FoamCalc's Pro tier is offered as an auto-renewing monthly subscription or an auto-renewing annual subscription, at the prices displayed in the App at the time of purchase. All subscriptions and purchases are billed and processed by the Apple App Store or Google Play, not by us directly.

• Free trial. The annual subscription starts with a 14-day free trial for new subscribers where the App Store or Google Play offers it. The trial converts to a paid annual subscription at the end of the 14 days unless it is canceled at least 24 hours before it ends. The App shows the trial's end date where the store reports it, and a reminder in the App in the last three days of the trial.
• Billing and auto-renewal. Monthly and annual subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before the renewal date, and your payment method on file with Apple or Google will be charged for renewal.
• Cancellation. Subscriptions can only be canceled through your Apple ID account settings or your Google Play account settings, not through the App and not through this Site, since neither FoamCalc nor Jack-High Software LLC has the ability to process a cancellation on your behalf.
• Refunds. All refund requests are handled exclusively under Apple's or Google's own refund policies, through their respective support channels. Jack-High Software LLC does not process refunds directly.

Acceptable use

You agree to use the App and Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of the App or Site by, any other person.

Intellectual property

The App, the Site, and their content, including text, graphics, calculators, and design elements, are the property of Jack-High Software LLC unless otherwise noted, and are protected by applicable intellectual property laws. You may not reproduce, distribute, reverse-engineer, or create derivative works from the App or Site without our prior written consent.

Disclaimer of warranties

The App and Site are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that calculations will be error-free, that the App will be uninterrupted, or that reference data (loss factors, yields, R-values, production rates, and similar figures) reflects your specific job conditions. These are editable defaults, not guaranteed facts. The R-values and set yields are widely published insulation and spray foam rules of thumb rather than a standard anyone is bound to, the other figures are FoamCalc's own starting defaults, and your own job history will beat them. You are responsible for adjusting them to match your own materials, equipment, and conditions.

Limitation of liability

To the fullest extent permitted by law, Jack-High Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or the cost of a misestimated job, arising out of or in connection with your use of, or inability to use, the App or Site, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the App, the Site or these Terms will not exceed the greater of (a) the amount you paid for FoamCalc Pro in the twelve months before the event giving rise to the claim, or (b) fifty US dollars (US $50). Some jurisdictions do not allow certain limits on liability, so some of the limits in this section may not apply to you.

Changes to these Terms

We may revise these Terms at any time. Continued use of the App or Site after changes are posted constitutes your acceptance of the revised Terms.

Where FoamCalc is offered

FoamCalc is offered in the United States and Canada. It works in US units, and the code table on its R-value reference screen is the 2021 IECC prescriptive table, which may not be the code in force where you work.

Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles.
